Welcome to Jest0r! These Terms of Service ("Terms") govern your use of the Jest0r mobile application and related services. By using Jest0r, you agree to these Terms.
1. Acceptance of Terms
By downloading, accessing, or using the Jest0r application ("App"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the App.
These Terms constitute a legally binding agreement between you and Jest0r regarding your use of the App and services.
2. Eligibility
To use Jest0r, you must:
Age Requirement: Be at least 13 years of age. If you are between 13 and 18 years old, you must have permission from a parent or legal guardian to use the App.
Legal Capacity: Have the legal capacity to enter into a binding agreement.
Account Accuracy: Provide accurate and complete information when creating your account.
Compliance: Not be prohibited from using the App under applicable laws or previously banned from our services.
3. Your Account
Account Creation
You may need to create an account to access certain features of Jest0r. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Account Security
You agree to:
Keep your password secure and confidential
Notify us immediately of any unauthorized use of your account
Not share your account with others or allow others to access your account
Not create multiple accounts for deceptive purposes
Account Information
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
4. User Content & Prompts
Your Content
Jest0r allows you to create prompts/challenges and upload video responses to prompts created by others ("User Content"). You retain ownership of your User Content, but by posting it on Jest0r, you grant us certain rights.
Creating Prompts
When creating prompts or challenges, you must ensure they are safe, legal, and appropriate. You agree not to create prompts that:
Could cause physical harm, injury, or endanger anyone's health or safety
Encourage or require illegal activities or dangerous behavior
Promote self-harm, eating disorders, or dangerous stunts
Target, harass, bully, or demean specific individuals or groups
Involve consumption of harmful substances or excessive amounts of food/drink
Require participation in sexually explicit or inappropriate activities
Violate privacy or require disclosure of personal information
Responding to Prompts
When creating video responses, you are solely responsible for your own safety and well-being. You agree to:
Use your own judgment before participating in any prompt or challenge
Not attempt any activity that could harm you or others
Understand that you participate at your own risk
Respect the rights and safety of others in your videos
Safety Warning: Just because a prompt exists on Jest0r does not mean it is safe or appropriate to attempt. You are responsible for your own safety. Do not attempt any challenge that could result in harm to yourself or others. When in doubt, don't do it.
License Grant
By submitting User Content to Jest0r, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the App and our business, including for promoting and redistributing part or all of the App.
Content Representations
You represent and warrant that:
You own or have the necessary rights to your User Content
Your User Content does not violate the rights of any third party
Your User Content complies with these Terms and our Community Guidelines
You have obtained consent from any individuals appearing in your content
Any prompts you create are safe, legal, and do not encourage harmful behavior
Important: We may remove any User Content, including prompts and responses, at our discretion, especially content that violates these Terms, poses safety risks, or violates our Community Guidelines.
5. Community Guidelines & Prohibited Conduct
Jest0r is built on creativity, fun, and community. To maintain a safe and positive environment, you agree not to:
Dangerous or Harmful Behavior
Create dangerous prompts: Do not create challenges that could result in physical harm, injury, or pose safety risks to participants
Perform dangerous activities: Do not film yourself or others engaging in activities that risk injury or harm
Encourage self-harm: No content promoting suicide, self-injury, eating disorders, or dangerous weight loss methods
Promote illegal activities: No prompts or responses involving illegal drugs, underage drinking, vandalism, or other unlawful behavior
Harassment & Hate
Bullying or harassment: Do not create prompts or responses designed to target, mock, or harm specific individuals
Hate speech: No content attacking people based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
Threats or intimidation: No threatening language or content intended to intimidate others
Inappropriate Content
Sexual content: No sexually explicit material, nudity, or prompts requesting inappropriate behavior
Violence & gore: No graphic violence, blood, or disturbing imagery
Shocking content: No content designed purely to shock, disgust, or disturb viewers
Platform Integrity
Spam or manipulation: Do not use bots, fake accounts, or artificial means to inflate engagement or game the crown system
Impersonation: Do not pretend to be someone else or misrepresent your identity
Copyright infringement: Do not post content that infringes on others' intellectual property rights
Exploit the platform: Do not attempt to hack, bypass security, or interfere with the App's functionality
Misleading content: Do not spread false information or create deceptive prompts
Reporting: If you see a dangerous prompt or inappropriate content, please report it immediately. We take user safety seriously and will review all reports.
Consequences: Violation of these guidelines may result in content removal, loss of crowns, account suspension, or permanent ban from Jest0r.
6. Crown System
Jest0r features a crown system to recognize outstanding creative content:
Awarding: Crowns are awarded to top-performing videos based on community engagement after prompts expire
No Monetary Value: Crowns are for recognition only and have no monetary or exchange value
Non-Transferable: Crowns cannot be transferred, sold, or exchanged between users
Discretion: Jest0r reserves the right to modify the crown system or revoke crowns for violations of these Terms
7. Intellectual Property
Our Content
The Jest0r App, including its design, features, functionality, and content (excluding User Content), is owned by Jest0r and is protected by copyright, trademark, and other intellectual property laws.
Trademarks
The Jest0r name, logo, crown imagery, and related marks are trademarks of Jest0r. You may not use these marks without our prior written permission.
Feedback
If you provide feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without restriction or compensation to you.
8. Termination
By You
You may stop using Jest0r at any time and request deletion of your account through the App settings or by contacting us.
By Us
We may suspend or terminate your account and access to the App at any time, with or without cause, with or without notice. Reasons for termination may include:
Violation of these Terms or Community Guidelines
Conduct that we believe is harmful to other users or the platform
Extended periods of inactivity
Request from law enforcement or government agencies
Effect of Termination
Upon termination, your right to use the App will immediately cease. We may retain certain information as required by law or for legitimate business purposes.
9. Disclaimers & Limitations of Liability
As-Is Service
Jest0r is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
User-Generated Prompts & Content
Prompts and challenges on Jest0r are created by users, not by Jest0r. We do not endorse, verify, or guarantee the safety of any user-generated prompts or content. You participate in prompts and challenges at your own risk.
We are not responsible for:
Injuries, harm, or damages resulting from participating in user-created prompts or challenges
The accuracy, safety, or legality of prompts created by users
Any consequences of activities you choose to perform in response to prompts
Interactions between users or disputes arising from User Content
Assumption of Risk
You acknowledge and agree that:
You are solely responsible for evaluating the safety and appropriateness of any prompt before participating
You assume all risks associated with creating or responding to prompts
Jest0r is not liable for any harm, injury, or damages you experience while using the App
You participate in all activities voluntarily and at your own risk
Limitation of Liability
To the maximum extent permitted by law, Jest0r and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Personal injury or property damage arising from your use of the App
Harm resulting from participating in user-generated prompts or challenges
Loss of profits, revenue, data, use, goodwill, or other intangible losses
Any damages arising from User Content or interactions with other users
In no event shall Jest0r's total liability exceed the amount you paid to Jest0r in the past twelve months, or $100, whichever is less.
Important: By using Jest0r, you agree that you are solely responsible for your own safety and the safety of others around you when participating in any prompts or challenges.
10. Changes to Terms
We may modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page and may notify you through the App or by other means.
Your continued use of Jest0r after any changes indicates your acceptance of the modified Terms. If you do not agree to the changes, you should stop using the App.

Usage Data: Information about how you interact with the App, including prompts viewed, videos watched, likes, follows, time spent on the app, and features used. This data helps us improve the app and personalize your experience.
Content Interaction Data: The types of content you engage with, including hashtags and topic categories you view, like, or create content for
App Store Analytics: Basic device and usage information provided by app stores (Apple App Store, Google Play Store) through their standard analytics tools
What We Don't Collect: We do not collect precise GPS location data, device-level tracking information beyond standard app store analytics, or browsing activity outside of the Jest0r app.
Information from Third Parties
Social Login: If you sign in using a third-party service (like Google or Apple), we receive basic profile information from that service
App Store Analytics: We receive aggregated, anonymized analytics data from Apple and Google app stores
2. How We Use Your Information
We use the information we collect to:
Provide Services: Operate, maintain, and improve the Jest0r App
Personalize Experience: Customize content, prompts, and recommendations based on your interests and activity. We analyze which topics and categories you engage with to show you more relevant content.
Communication: Send you notifications, account security alerts, updates, and service-related emails through our email service provider (SendGrid/Twilio)
Safety & Security: Maintain email records for account verification, detect and prevent fraud, abuse, and security issues
Analytics: Understand how users interact with our App to improve features and performance

Crown System: Evaluate and award crowns based on content performance
Business Analytics: Generate aggregated, anonymized insights about content trends and user interests across the platform (see Section 3 on Data Monetization)
3. Data Monetization
Aggregated Interest Data
To support and grow the Jest0r platform, we may share aggregated, anonymized data about content trends and user interests with advertisers and business partners. This helps us maintain Jest0r as a free service while connecting relevant advertisers with appropriate audiences.
What Data Is Shared
We analyze user engagement with content categories and hashtags (such as #funny, #sports, #music, #challenges, etc.) across our platform. We then share aggregated insights with advertisers, such as:
Overall popularity of specific content categories and topics
General trends in user interests and engagement patterns
Aggregated statistics about which types of content perform well
Example: We might share data showing "30% of Jest0r users engage with sports-related content" or "comedy challenges are trending this month." This helps advertisers understand broad audience interests without revealing anything about individual users.
What Data Is NOT Shared
We want to be clear about what we do not share:
Personal Information: We never sell or share your email address, username, password, or any personally identifiable information
Individual Activity: We do not share data about specific users' activities, viewing histories, or individual preferences
Video Content: Your uploaded videos and personal content remain private (visible only according to your privacy settings) and are not sold to third parties
Direct Messages: Any private communications remain confidential
Anonymization & Privacy Protection
All data shared with advertisers and partners is:
Aggregated: Combined data from many users, not individual user data
Anonymized: Stripped of any information that could identify specific users
Statistical: Presented as trends, percentages, and general insights rather than individual behaviors
We implement technical and procedural safeguards to ensure that the data we share cannot be traced back to individual users.

4. Information Sharing

Public Information
Your profile information, username, profile picture, and content you post are visible to other Jest0r users and may be publicly accessible.
Service Providers
We share information with trusted third-party service providers who help us operate our services. These providers are contractually obligated to protect your information and use it only for the purposes we specify. Our service providers include:
Cloud Hosting & Storage: Secure servers for storing app data and user content
Email Services: SendGrid and Twilio for sending account verification emails, notifications, and service updates
App Store Analytics: Apple and Google for basic app performance and usage analytics
Customer Support: Platforms that help us respond to user inquiries and support requests
Aggregated Data for Business Partners
As described in Section 3 (Data Monetization), we share aggregated, anonymized trend data with advertisers and business partners. This data cannot be used to identify individual users.
Legal Requirements
We may disclose information if required by law, legal process, or government request, or to protect the rights, property, or safety of Jest0r, our users, or others.
Business Transfers
If Jest0r is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you via email and/or prominent notice in the App of any such change in ownership or control of your personal information.

Your information is stored on secure servers. We retain your data for as long as your account is active or as needed to provide services, comply with legal obligations, resolve disputes, and enforce our agreements.

However, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security of your information.

Data Access & Deletion
You have the right to:
Access: Request a copy of your personal data
Correction: Request correction of inaccurate data
Deletion: Request deletion of your account and personal data

Opt-Out of Data Collection: Request to opt out of having your activity data included in aggregated analytics reports
To opt out of having your usage data included in aggregated, anonymized analytics that may be shared with advertisers:

Include your Jest0r username and registered email address
We will process your request within 30 days
Opting out will not affect your ability to use Jest0r or any of its features. However, it may limit our ability to personalize content recommendations for you.
Marketing Communications
You can opt out of promotional emails by following the unsubscribe link in any email or adjusting your notification settings in the App. Please note that even if you opt out of marketing emails, we will still send you essential account and security-related communications.
7. Children's Privacy
Jest0r is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at support@jest0r.com.
If we learn that we have collected personal information from a child under 13, we will take steps to delete that information as quickly as possible.
Users between 13 and 18 should review these terms with a parent or guardian before using the App.
8. International Users
Jest0r is operated from the United States. If you are accessing the App from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States or other countries where our servers or service providers are located.
By using Jest0r, you consent to the transfer of your information to countries outside your country of residence, which may have different data protection rules.
European Users (GDPR)
If you are located in the European Economic Area (EEA) or United Kingdom, you have additional rights under the General Data Protection Regulation (GDPR), including:
